— I — Acceptance.
By creating an account, submitting an application, paying for a membership, or otherwise using the GUSTUX site or app, you agree to these terms. If you don't agree, don't sign up — and if you've already signed up, you can cancel any time.
— II — Your membership.
Membership is granted on approval of an application by the editors. The editors' decision is final, but you can re-apply any time. Membership is personal — one human per account. Don't share your login.
Different tiers have different access. We may change what's in each tier from time to time. If we materially reduce what's in a tier you're paying for, we'll either grandfather your existing access or pro-rate a refund for the change.
— III — Conduct in the community.
The Hall and other member spaces are for honest conversation between adults who travel deliberately. The short version of the rules:
- Be civil. Disagreements are fine; ad hominem is not.
- Don't paste another member's private notes, photos, DMs, or location elsewhere.
- Don't use member channels to advertise, recruit, sell to, or pitch other members. The magazine accepts pitches; members don't pitch members.
- Don't post anything you can't post legally where you are.
- Don't impersonate anyone — including us.
- Don't try to break things on purpose.
If you violate this, the editors will ask you to stop. Repeated violations result in a warning, then suspension, then termination. The editors' judgement on what counts as a violation is final. We'll always tell you why.
— IV — Content you create.
You own everything you write, photograph, and upload to GUSTUX. Your journal entries, your photos, your dispatches, your notes in the Hall — all yours.
By posting content to a public-facing surface (a member dispatch in The Journal, a piece you pitch to the magazine), you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content within GUSTUX's surfaces (site, app, magazine, Annual). The license is non-transferable and ends when you delete the content or your account.
Private content (your journal, your atlas, your DMs) is not licensed to anyone. We display it back to you and store it for you, and that's it.
You can export and delete your content at any time.
— V — Content we create.
Pieces by the editors and contributors (the magazine, The Lists, The Annual, criticism, profiles, briefings) are © GUSTUX LLC and the named contributor, where applicable. Members may read, print for personal use, and quote brief excerpts with attribution. Members may not republish, repost, or scrape our content.
— VI — Payments and refunds.
Membership is billed monthly or yearly through Stripe. Yearly billing saves two months over monthly. We may run promotional rates from time to time; these are clearly marked.
Cancel any time. Monthly cancels at the end of the current cycle. Yearly: we pro-rate a refund for the unused months if you cancel before the cycle ends.
If we suspend or terminate your membership for cause, we refund the unused balance unless the cause is fraud or repeated abuse.
— VII — Adventures and challenges.
Hosted adventures are operated either by GUSTUX or by trusted partners. Each adventure has its own separate booking terms, cancellation policy, and waiver. You're responsible for your own visa, travel insurance, and fitness for the adventure.
Challenges are filed at your own risk. We do not endorse, supervise, or insure them. Use common sense.
— VIII — Contributors and pay.
If we commission a piece from you, you'll receive a contract before the work begins. The contract sets out the rate, the deliverables, the deadline, and the rights granted. Pay is set per piece, not per word, and we don't ask for spec work.
Contributors retain copyright; we license first publication and a non-exclusive right to keep the piece in the archive.
— IX — Termination.
You can close your account any time. We can suspend or terminate accounts for material breach of these terms — we'll tell you why, and we'll refund whatever's left.
If you close your account: public content stays in the archive with a "no longer a member" note unless you specifically request removal. Private content is deleted.
— X — Disclaimers.
GUSTUX is a publication and a community, not a travel agent or tour operator. We do not guarantee that anything in the magazine, the Hall, or member dispatches is accurate or current. Travel involves risk; the decisions are yours.
The site and app are provided "as is." We try hard to keep them up and working, but we don't promise uninterrupted service.
— XI — Liability.
To the maximum extent permitted by law, GUSTUX LLC's total liability to you for any claim arising out of your use of the site, app, or community is limited to the amount you paid us in the prior 12 months.
We are not liable for indirect, incidental, consequential, or punitive damages. We are not liable for the actions of other members, contributors, or third-party adventure partners.
Nothing in these terms limits liability where the law does not permit such limits (e.g. gross negligence, death or personal injury caused by us, fraud).
— XII — Disputes.
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules.
If we have a dispute, the first step is to email [email protected] and see if we can sort it out. If not, the dispute will be resolved in the state or federal courts of Delaware. EU consumers retain the rights guaranteed to them by their local consumer-protection law.
— XIII — Changes.
We may update these terms from time to time. If we make a material change, we'll email members at least 30 days before it takes effect, and we'll post a notice on this page. Continued use of GUSTUX after the effective date means you accept the new terms. If you don't accept them, you can cancel and we'll refund the unused balance.
